7. Age Restrictions
Our applications and website has a minimum age requirement of 13 years. No sections are specifically targetted at, or intended for use by, "children" or "preteens" under the age of 13. We do not believe users under the age of 13 should be participating in live chat sessions at that age. This website is a general audience website intended for many age groups but the 13 and under age group is not one of them. Depending on the actual chat room, the demographics can vary. For example, for the Kids Chat, 13 year old kids or 14 year old kids are allowed to participate on their own accord. We have blocked out users declared under 13 from logging in or registering on our chat rooms or forums. There are other various warnings and tools that have been implemented throughout the website to ensure that users fully understand this age restrictions and limitation. We do not knowingly allow anyone under this age to use our website. If known, either through discovery or a report submitted to us, the account will be terminated as soon as reasonably possible. If you, as a parent or guardian, have discovered that a child (who is under 13) has registered for a chat account or message forum account using a false age to bypass our age check, please contact us with your child's message forum username or chat username and we will have that account and any message postings he/she made deleted. An investigation and conclusion that the user is indeed under the age of 13 needs to be processed first but will be actioned promptly.
Important Note: The kids chat is for older kids and younger teenagers also known as "youths". Specifically, users aged 13-18 years old. Again, it not directed to users deemed as "young children" which would encompass users of a much younger age and below 13 years of age. Our moderators will, on occasion, implement their own age verification process via the private messaging system to prevent users under the age of 13 to continue to participate. This will only be used if an administrator or moderator suspects the user to not meet the age requirements. Moderators will also action submitted reports of when a user is known or self declared in text that they do not comply with the age restrictions of our website. Our reporting system will directly submit their age declaration to a moderator for review. Our moderation team has also been instructed to verify and action any users who they might suspect as being overage or underage for a particular chat room.There are several rooms which are strictly for users 18 and over. They are the Adult Chat, the Gay Chat, and sex chat rooms. Due to the content of the rooms, they are constantly monitored to ensure users underage will be removed. However, you, as a user, will be held solely responsible for your actions if you participate in those chat rooms. Age cannot be easily, immediately and reasonably expected to be verifiable beyond the measures we have already implemented.
8. User Generated Content
You may not post, submit or upload user generated content that is defamatory, harassing, violent, obscene, or otherwise offensive or harms other users or people in any way. This applies to all content whether or not such content is protected by law. We reserve the right to edit or remove any profile or content that we deem to be inappropriate. This includes about me sections, user profile moods or profile/background pictures, forum signatures or blog comments. It is solely based on our own discretion. We may also take a snapshot of the content if we feel it is necessary for submission towards any future legal proceedings held against you.
a. Hateful Content
#1 Chat Avenue does not tolerate any form of hateful or violent content in our chat rooms or on our forums. This includes threats, promotion of violence or direct attacks towards other users based upon ethnicity, race, religion, sexual orientation, religion affiliation, age, disability, serious diseases and gender. Users also are prohibited from using hateful images for their profile pictures/avatars. This includes usernames. All such comment will be removed when noticed or reported to our staff.
b. Illegal Content
#1 Chat Avenue does not tolerate any form of illegal content in our chat rooms or on our forums. Users also are prohibited from using or uploading illegal images including child pornography or other illegal content. This includes, but not limited to, profile pictures/avatars and any image transfers or uploads. This includes usernames used for nicknames and accounts. For pornographic material involving minors or children, please report this immediately to the Administrator. If you post illegal content, you will be subject to being kicked, banned and, in many cases, reported to law enforcement. #1 Chat Avenue will, to its highest ability, remove all illegal content when it is discovered or reported to us. We will not be held responsible for such content posted by users, however, we will take action against them. Illegal content MUST be reported to our staff through the proper channels as soon as it is noticed. In all cases, it will be actioned appropriately within a reasonably expected timeframe.
c. Explicit content
In general, this website prohibits the use of explicit content including anything sexual, racial and hateful. If there are any exceptions we would specifically specify that. If explicit content is posted in a chat room, blog or forum that is forbidden to do so, you will be subject to a kick or permanent ban of your account. Further action may be taken at our discretion, including but not limited to, contacting law enforcement.
d. Selling of Goods or Services
We do not allow selling of any sort of services or goods through our platform including advertising and promotional materials and content. This encompasses all channels we offer here (forums, blogs or chat). Selling of sexual or illegal material or services is subject to referral to law enforcement (in addition to a permanent ban). That is a major violation of, not only our website, but many local laws.
e. Intellectual Property Rights
We do not allow posting of content that violates third-party intellectual property rights. If you do not own the content, please do not post it.
f. Personal Details or Information
Do not post somebody's personal or private details or information. This includes yourself and third parties.
Report Terms of Service Violations
As specified throughout the website, please report any violation of terms of service violation to our moderation team using the tools found within the chat software and the chat forums.
9. Governing Law
Any claim relating to #1 Chat Avenue's web site shall be governed by the laws of the location of its webhosting servers without regard to its conflict of law provisions.

This website has chat moderators and administrators in every room. However, they may not be present 24 hours a day. This website will not be held responsible for criminal offences committed by users who abuse our service. We reserve the right to take appropriate legal action, including referral to law enforcement agencies for any crimes or abuse committed on our website. Our moderation team takes a pro-active approach to monitoring our chat rooms. We encourage users to refer all violations of terms of service to our moderation team. 13. User Risk
The services that this website offer, is a platform for chat services only. You acknowledge that using this website may subject you to content that you may find offensive, objectionable or indecent. By using our services, you acknowledge that the risks associated with such use is can potentially lead to harmful situations. This is especially true if you provide other users with personal information. You will assume all risks in these cases and this website will not be held responsible for your actions.
14. VIP Membership
This website offers VIP membership on some of our chat rooms. #1 Chat Avenue reserves the right to terminate a VIP membership at its sole discretion. Some reasons may include fraudulent purchase, violation of our rules and regulations, and violation of our terms of service. If you are banned for violating our terms of service or rules and regulations, refunds will not be given. If you do not log into your account for 3 months or more, we also reserve the right to terminate your VIP account.
The functions and features given to VIP members are subject to change at any time. This may include the removal or addition of features. It is in our sole discretion. The functions and features listed are at the time of purchase. Updates happen from time to time and those features may be subject to change. In the vast majority of cases, only additional features are added for the benefit of the VIP member.
All payments must be used with an authorized credit card or debit card. Use of fraudulent cards are illegal. If you are using the debit or credit card of a family member, that is allowed, however, please inform them and receive permission first.
You might be asked to verify your payment via email by the debit or credit card holder. The Administrator may reach out to you on your VIP account in the chat room. Failure to respond to the verification instructions will result in termination of VIP and subject to a ban for illegal use of a bank card.
It is also important to note that when you make a VIP purchase, under no circumstances will a refund be given due to "buyer's remorse" and if you do not want it anymore. The only circumstance where a refund is given would be if you accidentally made a duplicate payment.
The above terms will also apply to any VIP gifts or donations that are made to other users of this website.
VIP donated to your account cannot be removed upon request. As part of your agreement to use this website, you also agree that your account can be subject to a VIP gifted to your account. You are welcome to set your account on delete or cease to use the account permanently.
