Abortion law in the US: Roe v Wade to be overturned?

If the leaked draft Supreme Court decision is correct, Roe v Wade which legalised abortion in all States may be about to be overturned

The full leaked document can be found here but it's 98 pages long 🙁
tl; dr:

  • The Court isn't expressing an opinion on abortion per se. What they're saying is: It shouldn't have been a decision open to the SCOTUS to make but should have been decided by politicians on the basis that they represent the views of the people - essentially a technicality
  • If the draft decision becomes the final, it doesn't mean that abortion is illegal everywhere in the US. Some States already have State-level abortion laws. Those that don't will have to legislate to allow/outlaw it - quickly.

Here in Canada, abortion is not legal, It's just not illegal lol-- but is illegal (a Charter Violation)to punish anyone (ie doctors) who perform it.

I saw this supposedly leaked potential outcome yesterday as well. If Roe v. Wade is overturned, I personally feel it will be a huge step backwards for the United States. Criminalizing abortion doesn't limit abortions, it only limits access to safe abortions. America's healthcare system is already a steaming pile of rubbish. It will be an absolute shame if this is yet another medical procedure that people have limited access to in clinic, and women turn to back-alley abortions as a result.

Am I right in thinking that the 1st Trudeau legislated to deal with this but then the CSS overturned a jury finding a doctor not guilty (in the 70s?) so effectively struck down Trudeau's law?

Actually, this is wrong. If States have no laws outlawing it or regulating it, abortion is de facto legal until they legislate otherwise (or find some other law that can use to argue that it's illegal), so they are in the same position as Canadians

@LostCause. Couldn't have said it better myself
